Protection from eviction for commercial tenants

Commercial tenants who miss one or more rental payments due to the coronavirus pandemic are protected from eviction. This applies to rental payments due up to 30 June 2020, although the Government is open to extending this protection if necessary.

This is not a rental holiday for commercial tenants ― they are still liable for the payments. Therefore, it is suggested that commercial tenants who believe that they will be unable to pay their rent contact their landlord as soon as possible to discuss their options.

Although tenants are protected from evictions and companies are afforded some protection from insolvency via proposed changes to insolvency laws, neither of these measures prevent a landlord from the seeking legal action to recover unpaid debt. Such action could eventually lead to a winding up petition.
